PRIVACY POLICY

This Privacy Policy explains how Tutufy, Inc. collects, uses, shares, and protects your personal information when you use the Tutufy Platform. By using the Platform, you consent to the practices described herein.

1. INFORMATION WE COLLECT

1.1 Information You Provide Directly

  • Identity Information: Full legal name, date of birth, government-issued identification documents (passport, driver’s license, national ID), and photograph, collected for KYC/identity verification purposes;
  • Contact Information: Email, phone number, and mailing address;
  • Account Information: Username, password (stored in encrypted form), and profile details;
  • Transaction Information: Shipment details, item descriptions, declared values, travel routes, and delivery information;
  • Payment Information: Payment method details processed by our third-party payment processors (Tutufy does not directly store full payment card numbers);
  • Communications: Messages exchanged between Users through our Platform messaging system, and communications with our support team;
  • Ratings and Reviews: Content you submit about other Users.

1.2 Information Collected Automatically

  • Device Information: IP address, browser type, operating system, device identifiers;
  • Usage Data: Pages visited, features used, time spent, clicks, and navigation paths;
  • Location Data: General geographic location (if permitted by your device settings);
  • Cookies and Tracking Technologies: As described in our Cookie Policy.

1.3 Information from Third Parties

  • KYC Verification Providers: Identity verification results, watchlist screening results;
  • Payment Processors: Transaction confirmation and fraud signals;
  • Social Sign-On Providers: If you choose to register using a third-party account.

2. HOW WE USE YOUR INFORMATION

Tutufy uses personal information for the following purposes:
  • To create and manage your account and verify your identity;
  • To facilitate connections between Senders and Travelers;
  • To process payments and manage escrow arrangements through third-party processors;
  • To provide customer support and respond to inquiries;
  • To enforce our Terms of Service, Prohibited Items Policy, and other policies;
  • To detect, investigate, and prevent fraud and security issues;
  • To comply with legal obligations and respond to requests from government authorities;
  • To improve the Platform experience and internal operations;
  • To send service-related communications and, with your consent, marketing communications;
  • To maintain safety and security on the Platform.

3. IDENTITY VERIFICATION AND KYC DATA

Tutufy uses third-party identity verification services to verify User identities. This process involves collection of government ID documents and biometric facial comparison data. By completing the verification process, you consent to the collection, processing, and storage of this information by Tutufy and its verification partners.

Biometric data collected during the KYC process is subject to applicable biometric privacy laws, including the Minnesota Biometric Information Privacy Act (BIPA) to the extent applicable. Biometric identifiers and data collected for verification will be:

  • (a) used only for identity verification purposes;
  • (b) not sold, leased, or traded;
  • (c) retained only as long as necessary to fulfill the purpose of collection or as required by law; and
  • (d) protected using reasonable security measures.

4. INFORMATION SHARING AND DISCLOSURE

4.1 Sharing with Other Users

To facilitate Transactions, Tutufy shares certain information between Senders and Travelers, including profile information, ratings, general location for route matching, and contact information necessary to complete a Transaction. You should exercise caution in determining what additional information you share with other Users.

4.2 Sharing with Service Providers

Tutufy shares information with third-party service providers who assist in operating the Platform, including identity verification services, payment processors, cloud hosting providers, analytics providers, and customer support tools. These providers are contractually required to process information only as directed by Tutufy and in compliance with applicable law.

4.3 Sharing for Legal and Safety Purposes

Tutufy may disclose your information when required by law, court order, subpoena, or government request; to protect the rights, property, or safety of Tutufy, its Users, or the public; to investigate fraud, security breaches, or violations of our Terms; or in connection with an investigation of suspected illegal activity, including customs violations or smuggling.

4.4 Business Transfers

In the event of a merger, acquisition, or sale of all or substantially all of Tutufy's assets, your information may be transferred to the successor entity, subject to comparable privacy protections.

4.5 No Sale of Personal Data

Tutufy does not sell your personal information to third parties for their own marketing or commercial purposes.

5. INTERNATIONAL DATA TRANSFERS

Tutufy is based in Minnesota, United States. Because the Platform facilitates international transactions, your information may be transferred to, stored, and processed in countries other than your country of residence. By using the Platform, you consent to the transfer of your information to countries that may have different data protection laws than your country. Tutufy will take appropriate safeguards to protect your information in accordance with applicable law.

Where required by law, Tutufy will implement standard contractual clauses or other legally required transfer mechanisms for cross-border data transfers.

6. DATA RETENTION

Tutufy retains personal information for as long as your account is active or as needed to provide you Services. We also retain personal information to comply with our legal obligations, resolve disputes, and enforce our agreements. For certain Transacting Users, we may be required by law to retain certain information for specific periods, for example to comply with applicable anti-money laundering and KYC regulations. Transaction records will be retained for a minimum of seven (7) years to comply with financial recordkeeping requirements.

7. YOUR RIGHTS AND CHOICES

Depending on your location, you may have the right to:
  • Access the personal information Tutufy holds about you;
  • Request correction of inaccurate personal information;
  • Request deletion of your personal information, subject to legal retention obligations;
  • Object to or restrict certain processing of your information;
  • Receive a copy of your data in a portable format;
  • Withdraw consent where processing is based on consent;
  • Opt out of marketing communications at any time.

8. SECURITY

Tutufy implements industry-standard technical and organizational security measures to protect your personal information from unauthorized access, disclosure, alteration, and destruction. However, no security system is impenetrable. Tutufy cannot guarantee the absolute security of your information, and you transmit information to the Platform at your own risk. In the event of a data breach affecting your rights and freedoms, Tutufy will notify you as required by applicable law.

9. CHILDREN’S PRIVACY

The Platform is not directed to individuals under the age of 18. Tutufy does not knowingly collect personal information from minors. If we learn that we have collected personal information from a person under 18, we will promptly delete that information.

10. CHANGES TO THIS POLICY

Tutufy may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on the Platform and updating the effective date. Continued use of the Platform after changes constitutes acceptance of the revised policy.
