TUTUFY

USER ACKNOWLEDGMENT AND RISK ACCEPTANCE

This document sets forth important acknowledgments and risk disclosures that all Users must read and accept. By using the Tutufy Platform, you acknowledge having read, understood, and accepted all statements herein.

PART A — ACKNOWLEDGMENTS APPLICABLE TO ALL USERS

A.1 Marketplace Nature of Platform

I understand and acknowledge that Tutufy is solely a technology marketplace and intermediary platform. Tutufy does not provide, perform, guarantee, or oversee any shipping, delivery, courier, transportation, or logistics services. All services are performed by independent Users who are not employees, agents, or representatives of Tutufy.

A.2 No Guarantee of Transaction Completion

I understand that Tutufy does not and cannot guarantee that: any Listing will be accepted by a Traveler; any item will be picked up, transported, or delivered; any Transaction will be completed; any User I interact with will be honest, reliable, or competent; or any item will arrive in the condition it was sent. I accept these risks as inherent to the peer-to-peer nature of the Platform.

A.3 Identity Verification Limitations

I understand that while Tutufy conducts identity verification of Users, such verification does not guarantee the honesty, reliability, trustworthiness, or safe behavior of any User. Identity verification confirms the existence of a government-issued identity but does not screen for criminal history, moral character, or fitness for any purpose. I accept that I interact with other Users at my own risk.

A.4 International Legal Complexity

I understand that international transportation of goods is subject to complex and varying legal regimes, including customs laws, import/export regulations, and airline regulations that differ by country. I am solely responsible for understanding and complying with all applicable laws and regulations relevant to my use of the Platform. I will not hold Tutufy responsible for my failure to comply with any applicable law.

A.5 No Legal or Customs Advice

I acknowledge that Tutufy does not provide legal, customs, tax, or regulatory advice. Any information provided on the Platform regarding customs regulations or permitted items is general information only and may not be accurate, complete, or current. I will independently verify all regulatory requirements applicable to my transactions.

A.6 Assumption of Risk

I KNOWINGLY, VOLUNTARILY, AND EXPRESSLY ASSUME ALL RISKS ASSOCIATED WITH MY USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO: FINANCIAL LOSS; LOSS, DAMAGE, OR THEFT OF ITEMS; CUSTOMS SEIZURE OR DELAY; REGULATORY FINES OR PENALTIES; PERSONAL INJURY; PROPERTY DAMAGE; AND LEGAL LIABILITY. I ACCEPT THESE RISKS AS MY OWN AND RELEASE TUTUFY FROM ANY LIABILITY THEREFOR TO THE FULLEST EXTENT PERMITTED BY LAW.

PART B — SENDER-SPECIFIC ACKNOWLEDGMENTS

B.1 Accuracy of Declarations

I acknowledge that I am solely responsible for the accuracy, completeness, and truthfulness of all information I provide in my Listings, including item descriptions, dimensions, weight, contents, and declared value. I understand that inaccurate declarations may constitute fraud and may expose me to criminal and civil liability. I agree to accurately declare the full replacement value of all items I list.

B.2 Item Legality

I represent and warrant that all items I list for shipment are legal to possess, transport, and import or export under all applicable laws of all relevant jurisdictions. I understand that I am solely responsible for ensuring my items comply with all applicable laws and regulations, and I accept all legal consequences for items that are found to be illegal, undeclared, or improperly declared.

B.3 Traveler Protection

I acknowledge that Travelers who unknowingly carry illegal items on my behalf may face serious criminal consequences including arrest, prosecution, and imprisonment. I understand that knowingly causing a Traveler to carry illegal items constitutes a serious crime. I agree to provide complete and honest disclosure of all item contents to any Traveler I engage through the Platform.

B.4 Risk of Non-Delivery

I acknowledge the risk that items may not be delivered due to: Traveler failure to complete the Transaction; customs seizure or delay; airline baggage issues; loss or damage during transport; or other unforeseen circumstances. While the escrow system provides financial protection, Tutufy does not guarantee delivery of any item and is not liable for non-delivery.

B.5 Insurance

I acknowledge that items transported through the Platform may not be covered by the Traveler’s travel insurance, my own insurance, or any insurance policy unless separately arranged. I am solely responsible for obtaining appropriate insurance for items I wish to insure. Tutufy does not provide or arrange insurance coverage for transported items.

PART C — TRAVELER-SPECIFIC ACKNOWLEDGMENTS

C.1 Customs Personal Responsibility

I understand and acknowledge that when crossing an international border, I am personally responsible for all items in my possession, including items I am carrying for others. I understand that ignorance of the contents of a package is generally not a legal defense to customs violations in most jurisdictions. I acknowledge that carrying undeclared, prohibited, or undervalued items on behalf of another person exposes me to serious criminal and civil liability for which Tutufy bears no responsibility.

C.2 Inspection Obligation

I acknowledge my right and strong encouragement to physically inspect all items before accepting them. I understand that by accepting a package without thorough inspection, I accept all risks associated with its contents. I will not carry any item I have not personally inspected and am satisfied is compliant with applicable regulations.

C.3 Financial Liability

I understand that if I carry items that result in customs fines, penalties, duties, or seizure, I may be held personally liable for such amounts. I accept that Tutufy will not indemnify me for financial consequences arising from items I voluntarily accepted to carry. I am responsible for understanding customs duty implications of items I carry.

C.4 Airline Compliance

I acknowledge that I am solely responsible for complying with all airline policies regarding baggage, prohibited items, and weight limits. I understand that carrying items on behalf of others may affect my airline's baggage liability coverage. I will not hold Tutufy responsible for any airline fees, fines, or penalties incurred.

C.5 Right of Refusal

I understand that I have an absolute right to refuse to carry any item at any time, for any reason, without penalty from Tutufy. I will exercise this right whenever I am uncertain about the contents, legality, or regulatory compliance of a package. I understand that accepting a shipment is entirely my own decision and I will not hold Tutufy responsible for consequences arising from my acceptance of any shipment.

PART D — ELECTRONIC ACCEPTANCE

By clicking “I Agree,” checking any acceptance box, creating an account, or otherwise using the Platform, I acknowledge that I have read, understood, and accept all terms in this User Acknowledgment and Risk Acceptance, the Terms of Service, Privacy Policy, Prohibited Items Policy, and Dispute Resolution and Liability Limitation Provisions. I acknowledge that my electronic acceptance is legally binding to the same extent as my handwritten signature.

I further acknowledge that these documents have been made available to me in a format I can save and print, and that I have had reasonable opportunity to seek independent legal advice before accepting these terms.
